This presentation will emphasize the strategic importance of proving the history of the abusive relationship through the admission of prior crimes and other acts evidence, nontestimonial statements, and statements that may be admissible under a theory of forfeiture by wrongdoing. The presenters will also discuss strategies for overcoming common defense claims of self-defense, accident, and “heat of passion.” This presentation will also discuss common sources of forensic evidence and how they can be utilized to strengthen prosecutions.
